Columbus Blood and Breath Test Defense Lawyers

Franklin County Breathalyzer Test Attorneys

At Scott Law Firm, LPA, in Columbus, our attorneys know that DUI defense often involves attacking the evidence that your blood alcohol level (BAC) was over the legal limit. Breathalyzer test results can be challenged on the basis that the machine is not accurate, or on the basis that the test was administered improperly. We look for opportunities to have the evidence against you thrown out, making it difficult to convict you of this serious crime.

Our lawyers represent people who have been accused of DUI. Whether you are a first-time offender or you have been charged with drunk driving before, we take an aggressive approach to these cases, striving to defeat the charges or minimize their impact. For a free consultation, call us locally at 614-441-8552 or toll free at 866-604-4026.

New Breathalyzers in Ohio

Many police officers in Ohio are currently using a new portable Breathalyzer called the Intoxilyzer 8000. They administer the test at the scene of the traffic stop, typically after asking the driver to perform the standard field sobriety tests. These new Breathalyzers are controversial because of potential inaccuracy. Despite this, the Ohio State Health Department purchased 700 of the machines with a $5 million federal grant in 2009. The majority of the 88 counties in Ohio are currently implementing the devices.

Are Breathalyzer Tests Accurate?

Breathalyzer tests, particularly portable Breathalyzer tests, should not be presumed reliable. In fact, the results of the portable Breathalyzer tests have been called into question by numerous experts in the field, and some courts have begun to suppress the 8000's test results in trial. Still, police use the results of these tests as a justification to arrest and charge people with DUI.
