When someone walks into court alone, charged with an OVI or a DUI, they are in trouble. The prosecutor is not likely to give them any consideration. They're going to end up with a much higher fine, a much higher days in jail, a more severe penalty and probably on probation for a much longer period of time.
The important factors for a first-time DUI offender, first and foremost, is mandatory jail time. Because if you walk into court alone at that first court date and plead guilty to the offense, you're going to go to jail.
