Defense Charges: Kidnapping & Sexual Assault

It’s something you would only expect to see on a television drama, but a decorated soldier accused of various sex crimes in three states is arguing that his “evil twin” is the true perpetrator.

The defendant, Aaron Gregory Lucas, is currently facing a total of 27 charges against him in Colorado, Alabama, and Texas. Those charges include kidnapping, child enticement, aggravated sexual assault, attempted sexual assault on a child, and sexual assault on a child. DNA matching Aaron Lucas was found at some of the crime scenes.

Last week, a judge in El Paso County, Colorado, ruled that Lucas could name his twin brother, Brian Lucas, as a suspect. This defense has been used before to create reasonable doubt, as the defendant knows that his or her identical twin sibling has identical DNA. Therefore, because DNA cannot exculpate or inculpate one sibling over the other, the case generally comes down to who has a better alibi. In the case of the Lucas twins, both brothers lived in Alabama and Texas at one time. However, Brian Lucas has only been to Colorado once in the past ten years and was never in El Paso County, where some of the crimes occurred.

Aaron Lucas, on the other hand, was stationed at Fort Carson in Colorado Springs, a town where some of the assaults occurred. Additionally, the crimes in Colorado began around the time that Aaron Lucas was first stationed at Fort Carson.

Brian Lucas, who has not been charged, has yet to comment on his brother’s defense. One might say that this takes sibling rivalry to a whole new level.
