REPRESENTED BY DEFENSE ATTORNEY JOE SCOTT, JUDGE DEEMS NELSON J. BREWER
LOW RISK FOR REPEAT OFFENSE
As reported in the Columbus Dispatch in an article entitled,
“
East Side man gets 6 months for videotaping co-workers in restroom“
, Nelson Brewer plead guilty and was sentenced with six months in the Franklin
County Community-Based Correctional Facility with three years of probation.
Brewer was an employee at Jack’s Pets in Canal Winchester, Ohio,
where he secretly videotaped female co-workers using the restroom. All
were adults with the exception of one seventeen year old. Forensic analysis
of his home computer revealed files of recordings all cataloged by the
names of each co-worker. The potential severity of the charges was significantly
increased with the files of the underage female because of state
voyeurism and possession of
child pornography laws.
According to the article, Brewer was described as a lonely type that lived
with his mother, and didn’t have any friends. Criminal defense attorney
Joe Scott was quoted as saying a prison sentence “would be a detriment
to him.”
Although Common Pleas Judge Tim Horton seemed to take his social difficulties
into account, he admonished Brewer severely by stating that he will always
be labeled as a “creep” as a result of his actions. In addition
to the jail sentence and probation, Brewer will be required to register
as a sex offender every six months for the next 25 years.
The Assistant Prosecutor Megan Jewett fought for harsh prison sentencing
in court. She said that Brewer’s actions required “planning,
thought and calculation” to plant a hidden camera and download recordings
on a nightly basis.
Despite the efforts of the prosecution, Brewer’s testimony, and the
compelling arguments of the Brewer’s lawyer were taken into consideration
and a prison punishment was avoided. Based on the facts, the judge deemed
that he was a low risk for repeat offense.
