Who says our dysfunctional legislative branch can’t act in a “bi-partisan” manner—both the Senate and the House have drafted legislation (“Justice Safety Valve Act of 2013”) which, if passed, would authorize judges to sentence below a statutory mandatory minimum in cases where the minimum is not necessary to protect public safety, and, would be unjust, given the facts and circumstances of the crime and defendant.
If this legislation becomes the law of the land, a federal judge could sentence below the mandatory minimum even if the defendant wasn’t the recipient of a §3553(e) motion for his cooperation. Wow, our system is evolving! Recently, a group of more than 50 former federal prosecutors and judges drafted a letter to Capitol Hill urging the passage of this transformative legislation.
