Former Michigan Supreme Court Justice Convicted of Bank Fraud off to Camp Cupcake
COME ON JUDGE, GIVE A FELLOW JURIST A BREAK!
Former Michigan Supreme Court Justice Diane Hathaway was convicted of bank fraud in connection with the short sale of her Michigan home and was sentenced to serve 12 months and one day in the BOP for her indiscretion. Hathaway was allowed to self-surrender to FPC Alderson to serve this sentence in August 2013—thus, the clock began running.
FPC Alderson is affectionately known as “Camp Cupcake” because of its relatively comfortable conditions, compared with some federal prisons. None other than the domestic goddess Martha Stewart had to tough out a federal prison sentence at Camp Cupcake.
However, Hathaway has had enough of prison life and wants to move into a halfway house but the BOP won’t consider this transition citing security and safety concerns because she is a former sentencing judge. Like most judges, Hathaway doesn’t handle rejection well.
Consequently, Hathaway filed a motion stating she’s being deprived of the equal protection of the law and requested her sentencing judge to either let her out early or allow her to serve the rest of her sentence at home. The government hasn’t yet responded to Hathaway’s motion but is expected to oppose her requested relief.
